The Native Vegetation Act 2003 (NVA) provides for Development Applications in addition to Property Vegetation Plans.
A Development Application under the NVA can permit the clearing of native vegetation, but cannot include provisions relating to the identification of regrowth, continuation of rotational practices. Unlike PVPs, a Development Application does not allow offsets to be included and the Murrumbidgee CMA is obliged to assess the application as submitted.
A Development Application must improve or maintain environmental outcomes without offsets, limiting this option to the thinning or removal of environmental weeds.
Further, a Development Application has a limited timeframe of up to 2 years as apposed to the 15 year Property Vegetation Plan.
